《言論自由無罪　良心發言有理》香港公民代表會議就張錦雄、關靖豐等人因宏福苑大火相關言論被捕聲援動議

香港公民代表會議對於十一月二十九日至三十日期間，警務處國家安全處以「煽動」罪名拘捕前屯門區議員張錦雄、「四大訴求」聯署發起人關靖豐及一名災場物資站女義工一事，予以最嚴厲譴責，並向所有被捕者致以堅定聲援。

The Assembly of Citizens’ Representatives, Hong Kong issues its strongest condemnation regarding the arrest by the National Security Department of the Hong Kong Police between 29 and 30 November of former Tuen Mun District Councillor Kenneth Cheung Kam-hung, “Four Demands” petition initiator Miles Kwan Ching-fung, and a female volunteer at the disaster relief supply station, all on charges of “sedition”. We extend our unwavering solidarity to all those arrested.

大埔宏福苑五級大火至今奪去逾一百四十六條生命，約一百五十人下落不明。然而當市民要求真相與問責，港共政權的回應竟是逮捕與噤聲。關靖豐的聯署不過要求成立獨立調查委員會；張錦雄只是在社交媒體分享災情；女義工只是為災民搬運物資。提出問題的人被消滅，製造問題的人卻可逍遙法外。這就是今日香港。

本會強烈譴責港共中共政權：

一、以「煽動」為名，將自發義工、問責倡議者、前民選議員妖魔化為「以災亂港」的危險份子，動用國安機器拘捕參與人道救援的市民，是對人性的踐踏。

二、將市民自發建立的救援體系據為己有，搶奪功勞歸於「關愛隊」。因政府管理不善，火災後市民自發組織義工、設立物資站，「關愛隊」卻在警方配合下強行接管、驅趕真正付出的義工。這一切不過為迎合行政長官李家超記者會必然奉上的「感謝習主席」，讓市民善心淪為政治獻媚工具。

三、以拘捕製造寒蟬效應，威嚇本地及海外市民。然而當局低估了民憤：市民對政府施政無能、對涉事區議員兼前法團顧問黃碧嬌、前法團主席、工程顧問、與承建商「宏業建築」等人的圍標貪腐，早已忍無可忍。恐懼無法撲滅憤怒，香港人不會沉默。

以拘捕代替問責、以恐懼代替真相，正是導致災難的制度根源。當民主制度被瓦解、監察聲音被消滅，建築安全紅線便可被踐踏，圍標貪腐便可肆無忌憚。失去民主制度的「安全裝置」，最終演變成超過一百四十六條人命的慘劇。

問題解決不了，就解決提出問題的人。香港的制度正一步步走向高鐵事故後掩埋車廂的國度。

本會嚴正指出，以「煽動」罪名拘捕行使言論及結社自由的市民，違反《公民權利和政治權利國際公約》第9、19、21、22條及《基本法》第27條的保障。本會呼籲國際社會密切關注香港當局打壓言論自由、將問責噤聲化的行為，並促請各國政府根據其人權制裁機制，考慮對負責是次拘捕行動的官員採取針對性制裁

讓生者得到公義，願逝者得到安息。

“Freedom of Speech Is Not a Crime; Speaking Out in Good Conscience Is Just”
Motion of the Assembly of Citizens’ Representatives, Hong Kong in Support of Kenneth Cheung， Miles Kwan and Others Arrested for Remarks Related to the
Wang Fuk Court Fire

The five-alarm fire at Wang Fuk Court in Tai Po has claimed over 146 lives to date, with approximately 150 people still unaccounted for. Yet as citizens demanded truth and accountability, the Hong Kong-Communist regime responded with arrest and silencing. Miles Kwan’s petition merely called for the establishment of an independent commission of inquiry; Kenneth Cheung simply shared disaster information on social media; the female volunteer was merely transporting supplies for disaster victims. Those who raise questions are eliminated; those who created the problems roam free. This is Hong Kong today.

This Assembly strongly condemns the Hong Kong-CCP regime for:

I. Under the guise of “sedition”, demonising self-motivated volunteers, accountability advocates, and former elected representatives as dangerous elements “using the disaster to destabilise Hong Kong”, and deploying the national security apparatus to arrest citizens engaged in humanitarian relief—a trampling of humanity.

II. Expropriating the rescue system spontaneously established by citizens and claiming credit for the “Care Teams”. Due to the government’s poor management, citizens voluntarily organised volunteers and established supply stations following the fire, yet the “Care Teams” forcibly took over with police cooperation, driving out volunteers who had genuinely contributed. All of this serves merely to align with Chief Executive John Lee’s obligatory “thank President Xi” opening remarks at press conferences, reducing citizens’ goodwill to instruments of political sycophancy.

III. Creating a chilling effect through arrests to intimidate citizens both locally and overseas. Yet the authorities have underestimated public anger: citizens have long reached the limits of their patience with the government’s administrative incompetence and the bid-rigging corruption involving District Councillor and former Owners’ Corporation consultant Peggy Wong Pik-kiu, the former Corporation chairman, engineering consultants, and contractor “Wang Yip Construction”. Fear cannot extinguish anger. Hong Kong people will not be silenced.

Replacing accountability with arrests and truth with fear is precisely the systemic root cause of this disaster. When democratic institutions are dismantled and monitoring voices are silenced, building safety standards can be trampled and bid-rigging corruption can run rampant. The loss of democracy’s “safety mechanism” ultimately resulted in a tragedy claiming over 146 lives.

“If you cannot solve the problem, eliminate those who raise it.” Hong Kong’s system is moving step by step toward that of the country which buried train carriages after the high-speed rail accident.

This Assembly solemnly points out that arresting citizens exercising their freedom of speech and association on charges of “sedition” violates the protections guaranteed under Articles 9, 19, 21 and 22 of the International Covenant on Civil and Political Rights, as well as Article 27 of the Basic Law. This Assembly calls upon the international community to pay close attention to the Hong Kong authorities’ suppression of freedom of speech and silencing of accountability demands, and urges governments to consider targeted sanctions against officials responsible for these arrests under their respective human rights sanctions mechanisms.

May the living obtain justice; may the deceased rest in peace.
